摘要：传统知识国际保护已历经30多年历史,从是否要保护的争论焦点问题开始,逐渐取得了大部分国家就保护必要性、保护方式以及共享利益等领域的共识。虽然各国之间仍存在重大意见差距,同时传统知识国际保护的未来也障碍重重,但是世界知识产权组织等国际组织在国际条约的编撰以及各国在区域贸易协定中约定传统知识相关条款等国家实践推动了国际习惯法的形成。国际法的发展始终以国家实践为其核心,不论是传统的习惯法,还是条约法的编撰,国家实践无疑是推动国际法向前发展的动力之渊源。欧美国家主宰的国际社会秩序将淡出历史舞台,更多的发展中国家通过参与国际条约的制定或者国际习惯法的形成,扩大其在国际社会的话语权,传统知识的国际保护亦将体现上述国际法发展的未来趋势。
The country practice has always been to the core of development of international law. Both for traditional customary law and treaty law,the countries＇ practices are undoubtedly the power source to promote the development of international law. The international social order dominated by the European and American countries will fade out,and more and more developing countries will enlarge their participation in the international society by attending the formulation of international treaty or the international customary law. The international protection of traditional knowledge will reflect this kind of future trend of international law development.
