摘要：中国能源结构清洁转型需要氢能革命,而氢能革命应以法律革命为保障。中国氢能产业虽已呈现出快速发展之势,但法律制度的缺位成为重要的阻却因素。美、韩两国业已构筑了体现本国国情的规范氢能产业发展的法律制度,两国氢能法的理念和制度安排皆有诸多可借鉴之处。在分析比较美、韩两国氢能法律制度的基础上,中国可借鉴美韩经验选择适当立法模式,构建涵盖管理体制、规划、发展激励和安全监管的氢能规则,为中国氢能发展提供制度保障。
The clean transformation of China?s energy structure calls for a hydrogen energy revolution,which needs to be guaranteed by a legal revolution.Although China?s hydrogen energy industry has shown a trend of rapid development,the lack of a legal system will become an important hindering factor.The United States and Republic of Korea have established legal systems that reflect their national conditions to regulate the development of the hydrogen energy industry,and there are many lessons to be learned from the concepts and institutional arrangements of the hydrogen energy laws of the two countries.Based on the analysis and comparison of the hydrogen ener-gy legal systems of the United States and Republic of Korea,learning from the experience of the two countries is helpful for China to choose an appropriate legislative model and construct hydrogen energy rules covering management system,planning,development in-centives and safety supervision,and then provide institutional guarantee for the development of China?s hydrogen energy.
