摘要：作者认为,我们有必要对民间法研究话语做一个解读。民间法研究反映出当代中国法学正在走出简单的唯国家中心主义立场,而转向社会本位的立场;在法学/法律制度的发展动力开始从唯政府推动的一元而转向多元;在法治建构上逐渐从一元图景取向向多元图景取向共存的立场过渡。当代中国民间法研究,是中国法学思想运动的一个重要内容。
